Welcome to www.matawhero.co.nz by Matawhero Wines Ltd. We exist to enable the purchase of our delicious distinctive wines by credit card using our website.
By using the Matawhero Wines Ltd online ordering facility, you acknowledge that you have read, understood and agree to be bound by the Terms & Conditions. When you purchase wine via www.matawhero.co.nz, you accept these Terms and Conditions, and the specific conditions that apply to that purchase. “Customer” means you and other people who purchase the products on our website.

1. Purchase Terms
1.1 When purchasing products on the website the customer confirms and acknowledges they are over 18 years and are legally entitled to purchase alcohol. All purchasers of wine from this site declare that they are 18 years of age or older. The customer warrants they can produce sufficient evidence (e.g. NZ Driver’s License or Passport) of that entitlement on request or upon delivery of the product.
2. Price
2.1 All prices are stated in New Zealand Dollars (NZD) and include Goods and Services Tax (GST).
2.2 A delivery fee which covers the cost of sending the customer’s order by courier will be included in the total price at the time of purchase.
2.3 Matawhero Wines may vary the prices displayed on the website at any time without prior notice.
2.4 In the event that computer errors result in a material misstatement of the price of your order we may, prior to the receipt of your order or at any time thereafter, require that you pay us the difference between the amount actually paid by you in respect of your order and the correct amount payable.
3. Payment
3.1 Matawhero Wines Ltd operates a credit card payment process to enable you to make payment for all purchases of Goods. Your credit card details will be captured at the time you place an order. Your Credit Card will be charged once your order has been accepted and prior to dispatch.
4. Product Availability
4.1 All products are sold subject to their availability while stocks last. Matawhero Wines accepts no responsibility for its inability to supply products to the Customer where the product is unavailable or where stocks have been exhausted.
5. Delivery
5.1 Delivery will be made to a New Zealand address nominated by the Customer.
5.2 Matawhero Wines will endeavour to deliver the products to the specified address in a timely manner.
5.3 Matawhero Wines takes no responsibility for any failure to deliver, or delay in delivery caused by events outside of its control.
5.4 Risk of any loss, damage or deterioration of or to the Goods passes to the Customer on delivery of the goods to the specified address.
5.5 Nothing in these terms entitles the Customer to refuse to take delivery or return the products as being surplus to their needs or for any other reason other than those agreed herein.
5.5 Matawhero Wines reserves the right the withhold delivery of the Products to the Customer for any reason whatsoever.
5.6 Advice regarding order shortage or damage in transit must be given to Matawhero Wines no later than five working days after receipt of products.
6. Cancellation, Returns and Order Variations
6.1 The Customer may vary or cancel the order up to the point that the order is packed by contacting the Matawhero Wines Ltd office at +64 6 867 6140. Should the order have left the Matawhero Wines Cellar Door then we agree to refund the cost of the product but not the freight charges already incurred.
6.2 If for any reason the Customer is dissatisfied with their order, they must contact the Matawhero Wines Cellar Door within 7 days of the order at + 64 6 867 6140 for assistance.
7. Refunds
7.1 Matawhero Wines does not provide a refund if you have changed your mind about a particular purchase, so please choose carefully.
7.2 We will only exchange products in which we deem to be faulty. If the products you have received are faulty or defective in any way, please contact us to organise a replacement.
7.3 Proof of purchase must be included with any returned products.
7.4 Postage charges on returns are at the cost of the Customer.
7.5 Matawhero Wines is not liable for packages that are lost or damaged. Once the product leaves our warehouse, it is under the Customers ownership. If you would like to claim for lost or damaged products, please contact Fastway direct.
8. Use of Customer Information
8.1. Customers use of this website will generate certain information that will be recorded electronically by Matawhero Wines. Matawhero Wines will also record the Customer’s contact details, credit information and any related personal details that the Customer supplies. Matawhero Wines will add the customer’s email to their mailing list.
8.2. The Customer acknowledges that Matawhero Wines’ employees may use the information identified in the previous clause for purposes connected with the supply of services to the Customer. Such services include administration of the Customer’s order or account on the website and keeping the Customer up to date with new offers at Matawhero Wines. Matawhero Wines agrees not to disclose any of the Customer’s personal information without the Customer’s consent.
8.3. The Customer may at any time make a written request to see any personal information that Matawhero Wines holds or to ask to correct any mistakes in that information.
8.4. The Customer may at any time request that Matawhero Wines remove their details from the database.
9. Consent to Receipt of Electronic Messages
9.1. The Customer acknowledges that by agreeing to receive promotional material they expressly consent to their inclusion in Matawhero Wines’ direct marketing database and accept that they may, as a result, receive electronic communications and promotional communications from Matawhero Wines. The Customer has the right to ask Matawhero Wines at any time to stop sending online communications and promotional offers to them.
10. Security of Information
10.1. Matawhero Wines shall use its best efforts to prevent any unauthorised entry into the Matawhero Wines website. However, Matawhero Wines shall not be liable for any damage or loss whatsoever if any third party gains unauthorised access to the site.
11. Intellectual Property Rights
11.1 Matawhero Wines owns, controls and had the right to use and provide the website and all the content on the website, including text, images, articles, photographs, audio and video clips. You may electronically reproduce and store the content of the website solely for the purposes of viewing, using the services or saving website content, for your own personal use. You may not display or distribute the content of any part of the website or its content in public, including any reproduction in any form on the Internet, without our express permission.
11.2 Any infringement of our intellectual property rights will be fully enforced under New Zealand law.
12. Jurisdiction / Disputes
12.1. This website is provided for use by New Zealand residents. We make no representations that the website complies with the laws of any country outside of New Zealand.
12.2. These terms and conditions are governed by New Zealand law and any legal action against Matawhero Wines must be taken in a Court in New Zealand.
12.3. The Customer agrees that in the event of any legal dispute relating to these terms and conditions the parties will attempt to settle matters by way of mediation at first instance.
